Q: I was injured in a car accident and the other driver's insurance company has requested that I send them my medical records. Should I?
A: The insurance company needs to have any medical record that correlates to a bill that you want the company to pay. However, many insurance companies send blanket medical authorizations for you to sign which is not always advisable. You should not sign a broadly worded medical authorization because the insurance company can then get all of your records whether they are related to the claim or not. Insurance companies will often use details of your medical history to argue that your injury was a result of a pre-existing condition, thus lowering the amount of compensation they owe you. Medical records are private information that should only be provided after consulting with a qualified personal injury lawyer. If an insurance adjuster obtains your medical records, it could damage your ability to obtain compensation.
